EIGHT ROOM Cyber Mall Terms of Service

Article 1 (Purpose)

These Terms of Service set forth the rights, obligations, and responsibilities between EIGHT ROOM Co., Ltd. (hereinafter "Company") and users regarding the internet-related services (hereinafter "Services") provided through the EIGHT ROOM Cyber Mall (hereinafter "Mall") operated by the Company.

※ Note: The Korean version of these Terms of Service is the legally binding version. This English translation is provided for convenience only.

Article 2 (Definitions)

① "Mall" refers to a virtual business location set up by the Company to enable transactions of goods or services (hereinafter "Goods") through information and communication facilities such as computers, and also refers to the business operating the cyber mall. ② "User" means members and non-members who access the Mall and receive the Services under these Terms. ③ "Member" means a person who has registered by providing personal information to the Mall, who continuously receives information from the Mall, and who can continuously use the Services provided by the Mall. ④ "Non-member" means a person who uses the Services of the Mall without joining as a member.

Article 3 (Notification, Explanation, and Amendment of Terms)

① The Mall shall display on the initial service screen these Terms, the company name, business address, representative's name, business registration number, contact information, mail-order sales registration number, and the personal information protection officer, so that users can easily identify them. ② The Mall may amend these Terms within the scope that does not violate relevant laws, including the Act on the Consumer Protection in Electronic Commerce, the Act on the Regulation of Terms and Conditions, the Framework Act on Electronic Documents and Transactions, the Digital Signature Act, the Act on Promotion of Information and Communications Network Utilization and Information Protection, the Door-to-Door Sales Act, and the Framework Act on Consumers. ③ When the Mall amends these Terms, it shall notify users of the effective date and reasons for amendment along with the current Terms, posted on the initial screen of the Mall from seven days before the effective date until the day before the effective date. However, if the amendment is unfavorable to users, the Mall shall provide at least 30 days' advance notice and individual notification. ④ Amended Terms shall apply to contracts concluded on or after the effective date. If a user does not agree to the amended Terms, the user may request withdrawal of membership.

Article 4 (Provision and Modification of Services)

① The Mall provides the following services: 1. Provision of information on Goods and conclusion of purchase agreements 2. Delivery of Goods for which purchase agreements have been concluded 3. Other services determined by the Mall ② In the event of sold-out status or changes in technical specifications, the Mall may change the content of Goods to be provided under contracts yet to be concluded. In such cases, the changed content and the date of provision shall be posted immediately on the page where the current content of Goods is displayed.

Article 5 (Suspension of Services)

① The Mall may temporarily suspend the provision of Services in the event of maintenance, replacement, or malfunction of information and communication facilities, or communication disruption. ② The Mall shall compensate users or third parties for damages caused by temporary suspension under paragraph ①, unless the Mall had no intent or negligence. ③ If Services cannot be provided due to business transition, abandonment, or merger, the Mall shall notify users in accordance with Article 8 and compensate consumers according to the conditions originally presented by the Mall.

Article 6 (Membership Registration)

① Users apply for membership by filling out the member information in the registration form prescribed by the Mall and agreeing to these Terms. ② The Mall registers as members all applicants under paragraph ①, except in the following cases: 1. An applicant who has previously lost membership qualification under Article 7 paragraph ③. However, exceptions apply to those for whom three years have elapsed since loss of membership and who have obtained the Mall's consent for re-registration. 2. Registration contains false information, omissions, or errors 3. Other cases where registration is deemed significantly disruptive to the Mall's technical operations ③ A membership agreement is formed when the Mall's acceptance reaches the member. ④ Members must notify the Mall immediately by email or other means of any changes to registered information.

Article 7 (Withdrawal and Loss of Membership)

① Members may request withdrawal at any time, and the Mall shall process withdrawal immediately. ② The Mall may restrict or suspend membership qualification if a member falls under any of the following: 1. False information was registered at the time of application 2. Failure to pay, by the due date, fees for Goods purchased through the Mall or other obligations incurred in connection with use of the Mall 3. Threatening the order of electronic commerce by interfering with other users' use of the Mall or misappropriating information 4. Engaging in acts prohibited by law or these Terms, or contrary to public order and morals, through the Mall ③ After the Mall has restricted or suspended membership qualification, if the same act is repeated more than twice or the cause is not rectified within 30 days, the Mall may terminate membership qualification. ④ When terminating membership qualification, the Mall shall cancel member registration. In this case, the Mall shall notify the member and provide an opportunity to explain within a period of at least 30 days before cancellation.

Article 8 (Notification to Members)

① When the Mall notifies members, it may use the email address designated in advance by the member. ② For notifications to unspecified numerous members, the Mall may substitute individual notification by posting on the Mall's bulletin board for at least one week. However, matters significantly affecting a member's own transactions shall be notified individually.

Article 9 (Purchase Application and Consent to Personal Information)

① Users apply for purchase on the Mall through the following or similar methods, and the Mall shall provide the following information clearly to users at the time of application: 1. Search and selection of Goods 2. Input of the recipient's name, address, phone number, email address, etc. 3. Confirmation of the Terms, services for which withdrawal of subscription is limited, and costs such as delivery fees and installation fees 4. Indication of agreement to these Terms and confirmation or rejection of item 3 5. Application for purchase and confirmation of the purchase and the Mall's response thereto 6. Selection of payment method ② If the Mall needs to provide personal information to third parties, the Mall shall obtain the purchaser's consent at the actual time of purchase, not through blanket consent at the time of membership registration. The Mall shall specify the items of personal information provided, the recipient, the recipient's purpose of use, and the retention and use period.

Article 10 (Formation of Contract)

① The Mall may decline a purchase application under Article 9 in the following cases. When contracting with a minor, the Mall must notify that the minor or the legal representative may cancel the contract if consent of the legal representative is not obtained. 1. Application contains false information, omissions, or errors 2. A minor attempting to purchase Goods prohibited by the Juvenile Protection Act, such as tobacco or alcohol 3. Other cases where acceptance is deemed significantly disruptive to the Mall's technical operations ② A contract is deemed formed when the Mall's acceptance, in the form of a confirmation notice under Article 12 paragraph ①, reaches the user.

Article 11 (Payment Methods)

Payment for Goods purchased at the Mall may be made by the following methods, as available. The Mall shall not charge any additional fees to the price of Goods based on the user's payment method. 1. Credit card or debit card payment 2. Real-time bank transfer 3. Virtual account deposit 4. Payment by electronic means such as gift certificates, coupons, or reward points 5. Other electronic payment methods

Article 12 (Receipt Confirmation, Modification, and Cancellation of Purchase Application)

① The Mall shall send a confirmation notice upon receipt of a user's purchase application. ② A user who receives a confirmation notice may request modification or cancellation of the purchase application immediately in case of discrepancy. The Mall shall process such requests without delay before shipment. However, if payment has already been made, the provisions of Article 15 on withdrawal of subscription shall apply.

Article 13 (Delivery of Goods)

① Unless otherwise agreed with the user regarding the time of delivery, the Mall shall take necessary measures such as custom production and packaging so that Goods can be delivered within seven days of the application date. If the Mall has already received full or partial payment, measures shall be taken within three business days from the date of receipt of payment. ② Free shipping is provided for purchases of KRW 50,000 or more; a shipping fee of KRW 3,000 applies to purchases under KRW 50,000. Additional shipping fees may apply to Jeju Island and remote areas. ③ The Mall specifies the means of delivery, the party bearing delivery costs, and the delivery period. If the Mall exceeds the agreed delivery period, it shall compensate the user for any resulting damages, unless the Mall proves it had no intent or negligence.

Article 14 (Refund)

If the Mall cannot deliver or provide Goods applied for by a user due to reasons such as being sold out, it shall notify the user of the reason without delay. If payment has already been received, the Mall shall refund within three business days of receipt of payment or take necessary measures for refund.

Article 15 (Withdrawal of Subscription)

① A user who has entered into a purchase contract with the Mall may withdraw the subscription within seven days from the date of receiving the written contract under Article 13 paragraph ② of the Act on the Consumer Protection in Electronic Commerce (or the date of receipt or start of supply of Goods if later). However, if there is separate provision in the Act, such provision shall apply. ② Users cannot return or exchange Goods in the following cases after delivery: 1. Goods are lost or damaged due to reasons attributable to the user (however, withdrawal is permitted if packaging is damaged for the purpose of inspecting the Goods) 2. The value of Goods has significantly decreased due to use or partial consumption by the user 3. The value of Goods has significantly decreased over time to the extent that resale is difficult 4. For Goods that can be reproduced in the same condition, when the original packaging has been damaged 5. For fragrances, diffusers, body products, and similar items where resale is difficult due to hygiene and quality control concerns after opening, withdrawal may be restricted if there is evidence of opened packaging or use. ③ In cases falling under paragraph ② items 2 to 5, withdrawal shall not be restricted if the Mall has not clearly indicated the restriction in a place easily visible to consumers or provided trial products. ④ Notwithstanding paragraphs ① and ②, users may withdraw the subscription within three months of receiving Goods or within 30 days of becoming aware that the content of Goods differs from the displayed or advertised content, or that the contract was performed differently from the agreed terms.

Article 16 (Effects of Withdrawal of Subscription)

① Upon receipt of returned Goods from a user, the Mall shall refund the payment received within three business days. If the refund is delayed, the Mall shall pay interest for the delay calculated at the delay interest rate prescribed by relevant laws. ② When refunding through a credit card or electronic money payment, the Mall shall without delay request the payment service provider to suspend or cancel the billing for the Goods. ③ The cost of returning Goods in case of withdrawal shall be borne by the user. The Mall shall not claim penalty fees or damages for withdrawal. However, if withdrawal is due to content differing from displayed or advertised content, the cost of returning Goods shall be borne by the Mall.

Article 17 (Personal Information Protection)

① The Mall collects the minimum personal information necessary to provide Services. ② The Mall does not collect information needed for performance of purchase contracts in advance at the time of membership registration, and does not use personal information beyond the scope consented to by users, except where collection is required by law. ③ When collecting personally identifiable information, the Mall shall obtain the user's consent. ④ Provided personal information shall not be used for purposes other than those consented to, nor provided to third parties without user consent. The Mall is responsible for all such obligations. Exceptions apply in the following cases: 1. Providing minimum information (name, address, phone number) to delivery companies for delivery operations 2. Providing information in a form that does not identify specific individuals for statistics, academic research, or market research 3. For payment settlement necessary for Goods transactions 4. For identity verification to prevent fraud 5. When unavoidably required by law ⑤ Users may request at any time access to and correction of their personal information held by the Mall. The Mall shall take necessary action without delay. If a user requests correction of errors, the Mall shall not use the relevant personal information until the errors are corrected.

Article 18 (Obligations of the Mall)

① The Mall shall not engage in acts prohibited by law or these Terms, or contrary to public order and morals, and shall do its best to continuously and stably provide Goods and services as prescribed by these Terms. ② The Mall shall maintain security systems for the protection of users' personal information (including credit information) so that users can safely use internet services. ③ If a user suffers damage due to the Mall engaging in unfair display or advertising acts prohibited under Article 3 of the Act on Fair Labeling and Advertising, the Mall shall be liable for compensation. ④ The Mall shall not send promotional emails for commercial purposes that users do not want.

Article 19 (Obligations of Members Regarding ID and Password)

① Except as provided in Article 17, responsibility for managing IDs and passwords rests with members. ② Members shall not allow third parties to use their IDs or passwords. ③ If a member becomes aware that their ID or password has been stolen or is being used by a third party, they must notify the Mall immediately and follow the Mall's guidance.

Article 20 (Obligations of Users)

Users shall not engage in the following acts: 1. Registering false information at the time of application or modification 2. Misappropriating others' information 3. Altering information posted on the Mall 4. Transmitting or posting information other than that specified by the Mall (such as computer programs) 5. Infringing copyrights or other intellectual property rights of the Mall or third parties 6. Damaging the reputation of or interfering with the business of the Mall or third parties 7. Publicly disclosing or posting obscene or violent messages, images, audio, or other information contrary to public order and morals on the Mall

Article 21 (Copyright Ownership and Use Restrictions)

① Copyrights and other intellectual property rights for works created by the Mall belong to the Mall. ② Users shall not use information obtained from the Mall for which intellectual property rights belong to the Mall, through reproduction, transmission, publication, distribution, broadcasting, or other means for commercial purposes, or allow third parties to do so, without prior consent of the Mall. ③ If the Mall uses copyrights belonging to users under agreement, it shall notify the user.

Article 22 (Dispute Resolution)

① The Mall establishes and operates a damage compensation handling body to reflect legitimate opinions or complaints raised by users and to process damage compensation. ② The Mall shall give priority to processing complaints and opinions submitted by users. However, if prompt processing is difficult, the Mall shall immediately notify the user of the reasons and the processing schedule. ③ In the event of a dispute between the Mall and a user regarding electronic commerce, if the user requests damage relief, the parties may follow mediation by the Fair Trade Commission or a dispute mediation body commissioned by the Mayor or Provincial Governor.

Article 23 (Jurisdiction and Governing Law)

① Litigation on electronic commerce disputes between the Mall and users shall be subject to the jurisdiction of the district court of the user's address at the time of filing. If there is no address, jurisdiction lies with the district court having jurisdiction over the user's residence. If the user's address or residence is unclear at the time of filing, or if the user is a foreign resident, the case shall be filed with the competent court under the Civil Procedure Act. ② Electronic commerce litigation between the Mall and users shall be governed by the laws of the Republic of Korea.

Addendum

These Terms shall take effect on January 1, 2026.
